1. Representative Light@home is represented by Michiel Wouters and has her head office at 8890 Moorslede, Kerkhofstraat 12A. The VAT Number is BE 0886.131.523 (“Representative”). 2. Application Each order is considered acceptance by Buyer of our terms and conditions, which are an integral part of the agreement, excluding any other general or special conditions based on the seller, unless expressly otherwise agreed in writing. 3. Tenders and acceptance of the order All our offers are without engagement. We are only bound by an order after we have confirmed in writing or after we started with the implementation. The information about the products and pricing, and the detailed order information, are prepared and communicated to alteration and correction. 4. Delivery The products are delivered only in the countries where the site permits the delivery. The delivery of the products will be done as far as possible within the time is given by in the individual order confirmation. Incorrect passed delivery addresses are the responsibility of the Buyer and may lead to additional costs. Unless otherwise stated prices do not include the transportation and delivery of the goods to the Buyer. The cost of transportation and delivery are listed separately. The delivery times are not binding, but merely as guidance. No delay in delivery may lead to termination of the purchasse or payment of damages in favor of the Buyer, except in cases of intentional delay. By design-lighting can the delivery time increase. If there are already more than 2 months elapsed since the order, there is the option to cancel in writing. Unless contradictory clause, will rights, taxes and transportation costs charged to the customer. We have the right to carry out partial deliveries. Lightathome is not responsible for possible dammage, delay or loss during transport. On demand of the buyer the delivery can be insured for an additional price. Contact us for more information before u order.5. Retention The delivered goods remain our proporty until full payment of the price, including all costs and charges, default interest and fees. By failure to pay, we reserve legally the right to take back the goods and at expense of the Buyer. 6. Complaints Complaints are to be admissible, come to us: (a) in case of complaint for non-confirming delivery, five (5) days after delivery and (b) in case of hidden defects, five (5) days after discovery of the defect or after the time that such discovery could reasonably happen. The receipt of the goods by the Buyer covers every possible defect or non-compliance which could then be determined. 7. Guarantee Our guarantee is limited to the guarantee for hidden defects and the guarantee in case of consumer sales, both provided in the Civil Code. We are only responsible for damages caused by intent or gross error. We are not liable for general or special indirect damage of any kind, suffered by the Buyer. The seller can not be held liable for damage to equipment or facilities due to the weather such as storms, snow, hail, water infiltration, lightning, etc,..; defects caused by the surge of electricity, the defects caused by incorrectly connecting devices and wiring by the customer, wear or defect caused by negligent maintenance, overheating by using too high wattage bulb or halogen lamp; indirect costs caused by the activity of the defective product. All returned product MUST be 100% complete, contain ALL origienal packaging, all manuals and all accessories and documentation of the manufacturer. 8. Right to cancel Under the distance selling to consumers within the scope of the Act of 14 July 1991 the consumer has the right to notify the seller that he renounces the acquisition, without penalty and without giving any reason within seven workdays from the day following the delivery. If the consumer rely on this possibility, must he return the goods at own risk and costs to Light@home, Kerkhofstraat 12A, 8890 Moorslede, Belgium. Only the goods without the transport costs will be paid back. Reutrned goods will only be accepted and refunded if those still sit in the original and not damaged packaging. Goods that specifically designed or ordered for the Buyer are not reversed and the Buyer con not rely on the renunciation clause. 9. Force majeure We are not liable for delay in performance or non-performance of our obligations due to events beyond our normal control, including production interruptions, difficulty landing or shortages of raw materials, labor, energy or transportation, or delays in transportation, strikes, lock-outs, work interruptions or other collective labor disputes, either ourselves or our suppliers get, and even if those events are foreseeable. 10. Prices and payment Prices are listed as online are binding unless there is force majeure. The delivered goods remain the property of the seller until full payment of the invoices. If the shipment to abroad, Ligth@home acts as the exporter and the consignee as importer. Local recycling contributions should be indicated by the recipient. Light@home can not be held responsible for the identification of local or national recycling contribution. 11. Personal data By ordering on the website of Light @ home, the Buyer expressly to carry out the processing and use of his / her personal data for purposes such as administration of the customer base, managing orders, deliveries and invoices, the monitoring of solvency, marketing and advertising. The processing for individualized marketing and advertising is done only if the customer expressly agreement stated during the ordering process. Light @ home will not transfer data to third parties. The Purchaser has the right to inspect all data and improvement. The Purchaser has at all times the right to charge to oppose the processing for direct marketing purposes. For more information, the Purchaser is invited to consult the public register kept by the Commission for Protection of Personal Privacy in Brussels. 12. Evidence All parties accept their relationship within the framework of the electronic proof (eg: e-mail, backups, ...). 13. Severability If an article of these conditions is declared invalid, will void the validity of the remaining items will resist. 14. Applicable law All agreements with the Seller are governed by Belgian law.
